The Multistate Bar Examination (MBE) is prepared and administered by the National Conference of Bar Examiners. It covers seven legal practice areas: Civil Procedure, Constitutional Law, Contracts, Criminal Law and Procedure, Evidence, Real Property, and Torts. The following practice tests contain multiple-choice questions based on these practice areas. Most of the questions in the tests below are based on hypothetical fact problems, each of which gives rise to a legal conflict between disputing sides that must be resolved through the legal process. You must resolve the dispute with legal reasoning and select the most likely answer from the four alternatives provided. Select the answer that you believe is best, given the facts, the law, and the circumstances.
The MBE Online Practice Exams (OPEs) are 100-question, annotated online practice exams that use questions drawn from actual MBEs administered in past years. (The questions have been retired and will not appear on a future MBE.) The annotations explain why each answer choice is correct or incorrect. Examinees can take the practice exam timed or untimed, receive feedback on their answers, and obtain a customized report designed to help identify strengths and weaknesses in six MBE subject areas: Constitutional Law, Contracts, Criminal Law and Procedure, Evidence, Real Property, and Torts.
